TO AMEND SECTION 9-1-1140, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ESTABLISHING PRIOR SERVICE CREDIT FOR PURPOSES OF THE SOUTH CAROLINA RETIREMENT SYSTEM, SO AS TO ALLOW A MEMBER WHO LEAVES COVERED EMPLOYMENT TO GO ON ACTIVE DUTY IN THE ARMED FORCES OF THE UNITED STATES AND WHO, BEFORE RETURNING TO COVERED EMPLOYMENT, ATTENDS UNDERGRADUATE OR GRADUATE SCHOOL TO RECEIVE CREDIT FOR UP TO TWO YEARS OF SUCH EDUCATION IN THE SAME MANNER PROVIDED BY LAW FOR OBTAINING CREDIT FOR OTHER GRADUATE OR UNDERGRADUATE EDUCATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 9-1-1140 of the 1976 Code, as last amended by Act 166 of 1993, is further amended by adding at the end:
"A member who leaves covered employment to go on active duty in the armed forces of the United States and who, before returning to such employment, attends graduate or undergraduate school, may establish up to two years' retirement credit for the education time in the same manner provided in the preceding paragraph."
SECTION 2. This act takes effect upon approval by the Governor.
