The General Assembly of the State of South Carolina, begun and holden at Columbia on the second Tuesday in January, being the 11th day of the month.

Pursuant to the provisions of the Constitution, the members of the Senate assembled this day in the Senate Chamber at 12 o'clock noon.

The Senate was called to order by the PRESIDENT, the Honorable Nick A. Theodore.

Proceedings were opened with prayer by the Chaplain, the Reverend George E. Meetze of Columbia, S.C. as follows:

Beloved, the prophet Isaiah called to his people in words translated in the New International Version, Chapter 2, verse 3:
"Come, let us go up to the mountain of the Lord...

He will teach us His ways,

So that we may walk in His paths."
Let us pray.

Oh Lord, the Almighty God, Isaiah's God, the God of our fathers: You are the convener of time... the giver of all new beginnings.

As we begin the Second Session of the 110th General Assembly of our beloved State, we come praying that, in this our new beginning, You will teach us Your ways that we may walk in Your paths.

Lift up our hearts with hope... and optimism... and courage lest we be overly influenced by the fears and forebodings of some.

Grant us the spirit of Him who taught us to pray... together:

"Our Father, who art in Heaven,

Hallowed by Thy Name, Thy Kingdom come,

Thy will be done, on earth, as it is in Heaven.

Give us this day our daily bread; and

Forgive us our trespasses, as we forgive

those who trespass against us; and

Lead us not into temptation, but

Deliver us from evil. For Thine is the

Kingdom, and the power, and the glory,

S. 841 -- Senators McConnell, Rose, Greg Smith, Reese and Washington: A BILL TO AMEND CHAPTER 7, TITLE 12 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CORPORATE TAX EXEMPTIONS, BY ADDING SECTION 12-7-236, SO AS TO PROVIDE FOR THE DESIGNATION OF THE TRI-COUNTY AREA (CHARLESTON, DORCHESTER, AND BERKELEY) AS AN ECONOMIC IMPACT ZONE; TO PROVIDE FOR A THREE-YEAR CORPORATE INCOME TAX EXEMPTION FOR NEW BUSINESSES LOCATING IN THE TRI-COUNTY AREA WITHIN THE NEXT FIVE YEARS; TO PROVIDE FOR AN INVESTMENT TAX CREDIT OF NOT MORE THAN TEN THOUSAND DOLLARS FOR CONSTRUCTION OF NEW BUILDINGS OR REPLACING EQUIPMENT WITHIN THE NEXT FIVE YEARS; AND TO PROVIDE FOR A FIFTY PERCENT PROPERTY TAX REDUCTION FOR FACILITIES BUILT ON FORMER UNITED STATES MILITARY INSTALLATIONS WITHIN FIVE YEARS AFTER CLOSURE.

S. 1007 -- Senator Setzler: A CONCURRENT RESOLUTION EXPRESSING THE DEEPEST SYMPATHY OF THE MEMBERS OF THE GENERAL ASSEMBLY TO THE FAMILY OF DR. H. COOPER BLACK, JR., DISTINGUISHED SURGEON AND PROFESSOR, UPON HIS DEATH DURING THE LEGISLATIVE INTERIM.

Whereas, the members of the General Assembly were deeply saddened to learn of the death of Dr. H. Cooper Black, Jr., during the legislative interim at the age of fifty-four; and

Whereas, Dr. Black was born in Orangeburg County, was a graduate of Wofford College, and received his medical degree from the Medical University of South Carolina; and

Whereas, he was a highly respected and admired surgeon throughout Lexington and Richland counties, and in addition was an outstanding teacher of young medical students as assistant clinical professor of surgery at the University of South Carolina Medical School; and

Whereas, Dr. Black served patients and his profession in many capacities including service as chief of staff and member of the board of trustees of the Lexington Medical Center, a member of the board of trustees of Lowman Home, a fellow of the American College of Surgeons, an affiliate of the Royal Society of Medicine of London, and a diplomat of the American Board of Surgery; and

Whereas, in addition to his demanding duties as a physician, he had a great love for the outdoors as evidenced by his membership in the Sandlapper Field Trial Club and as chairman of the South Carolina Sporting Dog Commission; and

Whereas, with the death of this truly fine man at the age of fifty-four, the people of Lexington and Richland counties and the State of South Carolina have lost a dedicated and capable surgeon, a gifted teacher, and a good friend; and

Whereas, the members of the General Assembly, by this resolution, would like to extend their sincere condolences to his wife, children, father, stepmother, and other members of his family upon his untimely death. Now, therefore,

That the members of the General Assembly express their deepest sympathy to the family of Dr. H. Cooper Black, Jr., distinguished surgeon and professor, upon his death during the legislative interim.

S. 1009 -- Senators Ford and Glover: A CONCURRENT RESOLUTION TO CAUSE THE BLACK LIBERATION FLAG TO BE FLOWN FROM THE FLAGPOLE ATOP THE STATE HOUSE AND INSIDE THE CHAMBERS OF BOTH HOUSES OF THE GENERAL ASSEMBLY AS OFFICIAL RECOGNITION OF THE STRUGGLE FOR LIBERATION AND SUBSTANTIAL CONTRIBUTIONS OF CERTAIN CITIZENS, IN KEEPING WITH THE LEGISLATIVE POLICY OF HONORING SUCH CONTRIBUTIONS THROUGH THE DISPLAY OF FLAGS.

Whereas, the United States Flag and the South Carolina Flag both fly above the State House and in the chambers of both houses of the General Assembly as official symbols of separate sovereign governments; and

Whereas, as a matter of legislative policy, the General Assembly has determined that it is proper to display flags other than the two official sovereign flags; and

Whereas, the purpose of this policy is to recognize the contributions of certain citizens past and to celebrate certain aspects of Southern culture and heritage; and

Whereas, the contributions of certain other citizens and certain other aspects of Southern culture and heritage have not heretofore been officially recognized by the display of a flag in their honor and memory; and

Whereas, these certain other citizens, alternatively known as Coloreds, Negroes, Blacks, and African-Americans, have made a substantial historical contribution to the development of the State of South Carolina through labor, industry, and loss of life; and

Whereas, such citizens have engaged in a long, gallant, and continuous struggle to achieve liberation and equality in this State and in the United States; and

Whereas, more than one million such citizens now reside in South Carolina, representing almost thirty percent of the state's population; and

Whereas, such citizens have adopted a flag to represent their struggle and unity under a common cause, both formally, through various political and cultural associations and organizations, and informally, by the incorporation of the colors of such flag in various insignia and memorabilia; and

Whereas, the flag originated in the early part of this century with Marcus Garvey and the Universal Negro Improvement Association, an organization devoted to the liberation of such citizens in the United States at a time when systematic inequality and blatant discrimination were a way of life; and

Whereas, the colors of the flag, red, black, and green, have been incorporated into the flags of various sovereign African nations that have been liberated from colonialism, as well as other nations populated largely by people of African descent. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That a flag, to be known as the Black Liberation Flag, consisting of single red, black, and green horizontal bars of equal dimensions, with the colors running from left to right, respectively, be flown from the flagpole atop the State House, as well as from the rostrums in the chambers of both houses of the General Assembly.

S. 1010 -- Senator Rose: A CONCURRENT RESOLUTION INVITING THE SOUTH CAROLINA DELEGATION OF THE UNITED STATES CONGRESS TO ADDRESS A JOINT SESSION OF THE LEGISLATURE REGARDING UNFUNDED FEDERAL MANDATES.

Whereas, the number of unfunded federal mandates imposed upon the states by the United States Congress has alarmingly increased in recent years; and

Whereas, this continuing imposition places South Carolina and her sister states in the precarious position of either attempting to fund the federal requirements with diminishing amounts of available revenue or jeopardizing eligibility for certain federal funds; and

Whereas, states and the United States Congress should engage in earnest discussions regarding the difficult posture in which the states have been cast and the urgent necessity of the states to receive monetary assistance for these mandates or relief from the enforcement of these unfunded decrees; and

Whereas, the members of the General Assembly of South Carolina desire to communicate personally with the South Carolina Delegation to the United States Congress concerning this critical problem so that our representatives may be completely cognizant of the effect the actions of the federal government have at the state legislative level and may be more sensitive to the difficulties unfunded federal mandates create. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That all members of the South Carolina Delegation to the United States Congress are respectfully requested to appear before a joint session of the General Assembly to discuss the problems related to unfunded federal mandates.

Whereas, the "B.A.C." buttons go on sale Wednesday, March 9, 1994; and
