TO AMEND SUBARTICLE 3, ARTICLE 9, CHAPTER 7, TITLE 20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CHILD SUPPORT, BY ADDING SECTION 20-7-940 SO AS TO PROVIDE THAT INTERFERENCE WITH PROVISIONS FOR VISITATION GRANTED BY A COURT IS NOT A DEFENSE TO NONCOMPLIANCE WITH AN ORDER FOR SUPPORT AND THAT THE NONPAYMENT OF A SUPPORT ORDER IS NOT A DEFENSE TO INTERFERENCE WITH PROVISIONS FOR VISITATION GRANTED BY A COURT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Subarticle 3, Article 9, Chapter 7, Title 20 of the 1976 Code is amended by adding:
"Section 20-7-940. (A) Interference with provisions for visitation granted by a court is not a defense to noncompliance with an order for support.
(B) The nonpayment of a support order is not a defense to interference with provisions for visitation granted by a court."
SECTION 2. This act takes effect upon approval by the Governor.
