TO AMEND ARTICLE 5, CHAPTER 11, TITLE 11, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PUBLIC FINANCE, BY ADDING SECTION 11-11-450 SO AS TO PROVIDE THAT ANY TAX, SUBSIDY, OR CHARGE WHICH IS ESTABLISHED, FIXED, LAID, OR LEVIED BY THE GENERAL ASSEMBLY MUST BE USED SOLEY FOR THE PURPOSE TO WHICH THE PROCEEDS OF THE TAX OR CHARGE WERE STATED TO BE APPLIED AT THE TIME THE LEGISLATION WAS ENACTED AND FOR NO OTHER PURPOSE, UNLESS TWO-THIRDS OF BOTH HOUSES OF THE GENERAL ASSEMBLY STATE OTHERWISE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 5, Chapter 11, Title 11 of the 1976 Code is amended by adding:
"Section 11-11-450. The General Assembly shall not expend revenue derived from the levy of any tax, subsidy, or charge for any purpose other than the purpose to which the proceeds of the tax or charge were stated to be applied at the time the legislation was enacted and for no other purpose, unless two-thirds of both houses of the General Assembly state otherwise."
SECTION 2. This act takes effect upon approval by the Governor.
