A BILL

TO AMEND SECTION 22-5-180, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PROHIBITION AGAINST A PERSON SWEARING OUT A WARRANT FROM SERVING THE WARRANT, SO AS TO PROVIDE THAT ANY PERSON, EXCEPT FOR JUDICIAL OR LAW ENFORCEMENT OFFICIALS, WHO SWEARS OUT A WARRANT FOR THE ARREST OF ANOTHER PERSON AND WHO LATER REQUESTS THAT THE CHARGE BE DROPPED OR WHO DECLINES TO PARTICIPATE IN THE PROSECUTION OF THE CHARGE MUST PAY A TWENTY-FIVE DOLLAR ADMINISTRATIVE FEE FOR DROPPING THE WARRANT OR NOT PARTICIPATING IN THE PROSECUTION OF THE CHARGE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 22-5-180 of the 1976 Code is amended to read:

"Section 22-5-180. No magistrate shall deputize the person swearing out a warrant in any case to serve it.

Any person, except for judicial or law enforcement officials, who swears out a warrant for the arrest of another person and who later requests that the charge be dropped or who declines to participate in the prosecution of the charge must pay a twenty-five dollar administrative fee for dropping the warrant or not participating in the prosecution of the charge."

SECTION 2. This act takes effect upon approval by the Governor.
