A BILL

TO AMEND SECTION 56-28-30, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ENFORCEMENT OF MOTOR VEHICLE EXPRESS WARRANTIES, NONCONFORMITY WITH EXPRESS WARRANTIES, AND REQUIRED NOTICE AND REPAIRS, SO AS TO CHANGE THE TERM OF SUCH WARRANTIES FROM "THE FIRST TWELVE MONTHS OF PURCHASE OR THE FIRST TWELVE THOUSAND MILES OF OPERATION, WHICHEVER OCCURS FIRST", TO "THE WARRANTY PERIOD".

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 56-28-30 of the 1976 Code, as added by Act 142 of 1989, is amended to read:

"Section 56-28-30. If a new motor vehicle does not conform to all applicable express warranties within the first twelve months of purchase or the first twelve thousand miles of operation, whichever occurs first during the warranty period, and the consumer reports the nonconformity to the manufacturer or its agent during the term of the express warranties warranty period, the manufacturer, or its agent, shall make those repairs as are necessary to conform the vehicle to the express warranties at no cost to the consumer, notwithstanding the fact that the repairs are made after the expiration of the term warranty period."

SECTION 2. This act takes effect upon approval by the Governor.
