A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-11-612 SO AS TO ESTABLISH SIMPLE TRESPASS AS A MISDEMEANOR AND PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 7, Chapter 11, Title 16 of the 1976 Code is amended by adding:

"Section 16-11-612. A person who, without legal cause or good excuse, enters upon the premises of another person without intent to harm any property is guilty of the misdemeanor simple trespass and, upon conviction, must be fined not less than thirty-five nor more than one hundred dollars, and may be imprisoned not more than sixty days."

SECTION 2. This act takes effect upon approval by the Governor.
