AN ACT TO AMEND ACT 199 OF 1971, AS AMENDED, RELATING TO THE NORTH GREENVILLE FIRE DISTRICT, SO AS TO PROVIDE THAT MEMBERS OF THE GOVERNING BODY MUST BE ELECTED ON THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER OF ODD-NUMBERED YEARS AND PROVIDE THAT THE TERMS OF MEMBERS SERVING ON THE EFFECTIVE DATE OF THIS ACT ARE EXTENDED UNTIL THEIR SUCCESSORS ARE ELECTED AND QUALIFY.

Be it enacted by the General Assembly of the State of South Carolina:

Board member to be elected

SECTION 1. Section 4 of Act 199 of 1971, as last amended by Act 726 of 1990, is further amended to read:

"Section 4. (A) There is established a Board of Fire Control for the North Greenville Fire District to be composed of five members who are elected for terms of four years as provided in subsection (D).

(B) Whenever a vacancy occurs in the board and there are more than sixty days until the next election, the vacancy must be filled by the Governor upon the advice and consent of the Greenville County Legislative Delegation only until the next election, at which time a successor must be elected to fill the remainder of the term. If there is less than sixty days remaining until the next election when the vacancy occurs, the office must remain vacant until a successor is elected at that election and qualifies for the remainder of the term.

(C) The members of the board shall serve without pay and shall file annually a report with the Greenville County Council, not later than the first of November of each year, showing all activities and disbursements made by the board during the year.

(D) (1) Notwithstanding the provisions of this section, beginning in 1997, members of the governing body must be elected on the first Tuesday after the first Monday in November of odd-numbered years. The terms of members serving on the effective date of the amendment of this section are extended until their successors are elected and qualify as follows:

(a) The two members who were elected in 1994 and terms were to expire in 1998 are extended to expire in 1999.

(b) The members whose terms expire in 1996 are extended to expire in 1997.

(2) At the expiration of the terms provided in this subsection, all members must be elected for terms of four years."

SECTION 2. This act takes effect upon approval by the Governor.
