TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 61-5-35 SO AS TO PROHIBIT DRINKING GAMES IN ESTABLISHMENTS WHICH SELL ALCOHOLIC LIQUORS FOR CONSUMPTION ON THE PREMISES, TO PROVIDE PENALTIES, AND TO DEFINE "DRINKING GAMES" AND "ALCOHOLIC LIQUORS".
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 61-5-35. (A) Drinking games are prohibited on the premises of establishments which sell alcoholic liquors for consumption on the premises whether initiated by the establishment licensee or a patron of the establishment.
(B) Upon a violation of subsection (A), an establishment licensee is guilty of a misdemeanor and, upon conviction, must be fined one thousand dollars or imprisoned one year.
(C) The Department of Revenue and Taxation shall promulgate regulations to carry out the provisions of this section.
(D) For purposes of this section:
(1) `Drinking games' include, but are not limited to, a contest or other endeavor that encourages or promotes the consumption of alcohol with extraordinary speed, in increased quantities, in a more potent form, or in any manner which leads to the possibility of the person becoming intoxicated. `Drinking games' does not include contests or endeavors in which alcoholic liquors are not used in the contest or endeavor but rather are used as a reward or prize.
(2) `Alcoholic liquors' means the same as the definition provided for in Section 61-3-20."
SECTION 2. This act takes effect upon approval by the Governor.
