Senate Bill 369 would amend Section 9-1-1860 of the South Carolina Code of Laws, 1976, related to establishing service credit for a member's former employment, so as to extend the eligibility to a contributing member who served without compensation as a member of the governing body of a municipality.
A review of this bill by the Retirement Division of the State Budget and Control Board indicates there will not be any fiscal impact upon the South Carolina Retirement System. Since benefits of the retirement systems are funded by contributions and earnings on investments, there will not be any additional impact upon the General Fund of the State.

TO AMEND SECTION 9-1-1860, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ELIGIBILITY OF A CONTRIBUTING MEMBER OF THE SOUTH CAROLINA RETIREMENT SYSTEM TO ESTABLISH SERVICE CREDIT FOR THE MEMBER'S FORMER EMPLOYMENT BY A MUNICIPALITY WHICH WAS NOT A COVERED EMPLOYER AT THE TIME OF SUCH EMPLOYMENT, SO AS TO EXTEND THE ELIGIBILITY TO A CONTRIBUTING MEMBER WHO FORMERLY SERVED AS A MEMBER OF THE GOVERNING BODY OF SUCH A MUNICIPALITY AND TO PROVIDE THAT PAYMENT OF A SALARY TO THE MEMBER OF THE GOVERNING BODY IS NOT A REQUIREMENT FOR ELIGIBILITY TO ESTABLISH SUCH SERVICE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 9-1-1860 of the 1976 Code, as added by Act 658 of 1988, is amended to read:
"Section 9-1-1860. Any A former employee or member of the governing body of a municipality of this State which is not a member of the system, employed in this State by an employer covered by the system, and who is currently a contributing member, may elect to receive prior service credit for service rendered as an employee or member of the governing body of a municipality of this State which is not a member of the system in the manner provided in Section 9-1-1840 9-1-1140 for payments to establish credit for federal civilian service, mutatis mutandi. Payment of a salary to a former member of the governing body of a municipality is not a requirement for eligibility under this section."
SECTION 2. This act takes effect upon approval by the Governor.
