A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 17-13-145 SO AS TO REQUIRE THE VICTIM COMPENSATION FUND TO COMPENSATE A PAWNBROKER FOR PROPERTY SEIZED UNDER CERTAIN CIRCUMSTANCES, TO REQUIRE THE FUND TO BE REIMBURSED BY AN OWNER RETRIEVING SEIZED PROPERTY, AND TO REQUIRE A LAW ENFORCEMENT AGENCY TO REIMBURSE THE FUND WITH THE PROCEEDS FROM THE SALE OF SEIZED PROPERTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 17-13-145. (A) When a law enforcement agency seizes property during a criminal investigation from a pawnbroker who has complied with the provisions contained in Chapter 39 of Title 40, the Victim Compensation Fund shall compensate the pawnbroker the amount of any outstanding loan principal secured with the seized property.

(B) At the completion of a criminal investigation or court proceeding, the owner of the seized property may retrieve it after reimbursing the Victim Compensation Fund the amount the pawnbroker received from the fund.

(C) If the owner of the seized property fails to retrieve it, then the proceeds from the sale of the property by the law enforcement agency must be used to reimburse the Victim Compensation Fund."

SECTION 2. This act takes effect upon approval by the Governor.
