TO AMEND SECTION 40-11-10, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS RELATIVE TO LICENSING OF CONTRACTORS, SO AS TO PROVIDE THAT GENERAL CONTRACTORS INCLUDE A PERSON WHO UNDERTAKES MARINE CONSTRUCTION FOR A FEE OF FIVE THOUSAND DOLLARS OR MORE AND THAT MECHANICAL CONTRACTORS INCLUDE A PERSON WHO UNDERTAKES MARINE CONSTRUCTION FOR ANY FEE AND TO DEFINE MARINE CONSTRUCTION; AND TO AMEND SECTION 40-59-10, AS AMENDED, RELATING TO DEFINITIONS RELATIVE TO LICENSING RESIDENTIAL BUILDERS, SO AS TO PROVIDE THAT RESIDENTIAL BUILDERS INCLUDE A PERSON WHO UNDERTAKES MARINE CONSTRUCTION FOR ANY FEE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 40-11-10 of the 1976 Code is amended to read:
"Section 40-11-10. For the purpose of this chapter:
(1) A `general contractor' shall be one who for a fixed price, commission, fee, or wage undertakes or offers to undertake the construction or superintending of construction of any building, highway, sewer, grading, improvement, reimprovement, structure, or part thereof, when the cost of the undertaking is thirty thousand dollars or more. However, a general contractor also is one who for a fixed price, commission, fee, or wage in an amount of five thousand dollars or more engages or offers to engage in such undertaking when the undertaking involves marine construction. Anyone A person who engages or offers to engage in such undertaking in this State shall be is deemed to have engaged in the business of general contracting in this State.
(2) A `mechanical contractor' is one who for a fixed price, commission, fee, or wage undertakes or offers to undertake any plumbing, heating, air conditioning, lighting protection work, or electric work when the cost of the undertaking is seventeen thousand five hundred dollars or more. However, a mechanical contractor also is one who for a fixed price, commission, fee, or wage in any amount engages or offers to engage in such undertaking when the undertaking involves marine construction. Anyone A person who engages or offers to engage in such undertaking in this State is deemed to have engaged in the business of mechanical contracting in this State.
(3) `Marine construction' means any activity in deep water installations and repairs done in harbors, inlets, sounds, bays, channels, or lakes."
SECTION 2. Section 40-59-10 of the 1976 Code, as last amended by Act 595 of 1990, is further amended to read:
"Section 40-59-10. For the purpose of this chapter, a `residential builder' is one who constructs a residential building or structure for sale or who, for a fixed price, commission, fee, or wage, undertakes or offers to undertake the construction or superintending of the construction of any building or structure which is not over three floors in height and which does not have more than sixteen units in the apartment complex, or the repair, improvement, or reimprovement thereof, to be used by another as a residence when the cost of the undertaking exceeds five thousand dollars. However, a residential builder also is one who for a fixed price, commission, fee, or wage engages or offers to engage in such undertaking when the undertaking involves marine construction activities in deep-water installations and repairs done in harbors, inlets, sounds, bays, channels, or lakes. Nothing in this chapter prevents any a person, or his a person's agents, from performing these acts on his the person's own residence or on his other real estate held for personal or rental, as opposed to speculative, purposes. Anyone who engages or offers to engage in such undertaking in this State is considered to have engaged in the business of residential building."
SECTION 3. This act takes effect upon approval by the Governor.
