TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 2-1-62 SO AS TO PROVIDE QUALIFICATIONS FOR A CANDIDATE FOR THE SENATE AND HOUSE OF REPRESENTATIVES; TO AMEND SECTION 2-1-40, RELATING TO RESIDENCY REQUIREMENTS OF CANDIDATES FOR THE HOUSE OF REPRESENTATIVES, SO AS TO DELETE THE RESIDENCY REQUIREMENT; TO AMEND SECTION 2-1-60, AS AMENDED, RELATING TO ELECTION DISTRICTS FROM WHICH MEMBERS OF THE SENATE MUST BE ELECTED, SO AS TO DELETE THE RESIDENCY REQUIREMENT FOR THE SENATE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 2-1-62. Any person otherwise qualified by law and the Constitution of this State may file as a candidate for the Senate or House of Representatives only if he is an elector of the district at the time he files for at least thirty days before the last day candidates may file for that office."
SECTION 2. Section 2-1-40 of the 1976 Code is amended to read:
"Section 2-1-40. Any person otherwise qualified by law and the Constitution of this State may file as a candidate and can be elected only in the district in which he is a resident. A person may file for only one House office. Terms of office shall be are for two years."
SECTION 3. The next to last paragraph of Section 2-1-60 of the 1976 Code is amended to read:
"Each Senate office shall constitute constitutes a separate and distinct office to which a separate number must be assigned. A candidate for the office of Senator must be a legal resident of the district in which he is a candidate."
SECTION 4. This act takes effect upon approval by the Governor.
