A BILL

TO PROVIDE THAT A CONTRACTOR IS NOT LIABLE TO THE OWNER OF BURIED PIPES OR CABLES FOR DAMAGE CAUSED BY THE CONTRACTOR TO SUCH PIPES OR CABLES SO LONG AS THE CONTRACTOR ACTS IN GOOD FAITH BY PROVIDING CERTAIN NOTIFICATION AND BY ALLOWING THE OWNER A REASONABLE AMOUNT OF TIME TO MARK THE LOCATION OF THE PIPES OR CABLES BEFORE EXCAVATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Notwithstanding any other provision of law, a contractor is not liable to the owner of buried pipes or cables for damage caused by the contractor to such pipes or cables so long as the contractor acts in good faith by notifying the owner, or a person who has agreed to so notify the owner, that the contractor intends to excavate the area where the owner's pipes or cables are buried and, following such notification, allowing the owner a reasonable amount of time to mark the location of the pipes or cables before the excavation.

SECTION 2. This act takes effect upon approval by the Governor.
