AN ACT TO AMEND SECTION 40-45-130, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXAMINATION OF PHYSICAL THERAPISTS, SO AS TO ESTABLISH THE PASSING SCORE FOR EXAMINATIONS; AND TO AMEND SECTION 40-45-80, RELATING TO REVENUE AND INCOME OF THE BOARD OF PHYSICAL THERAPY EXAMINERS, SO AS TO PROVIDE THAT ALL FEES OTHER THAN EXAMINATION FEES MUST BE REMITTED TO THE STATE TREASURER AND TO ESTABLISH FEES FOR VARIOUS SERVICES.

Be it enacted by the General Assembly of the State of South Carolina:

Passing examination scores established

SECTION 1. The third paragraph of Section 40-45-130 of the 1976 Code is amended to read:

"For examinations administered by the Professional Examination Service or Assessment Systems, Inc., before July 1, 1995, the passing score for the physical therapist exam and the physical therapist assistant exam is 1.5 standard deviations (70 converted pass point) below the mean for the raw score of the examination. After June 30, 1995, the criterion referenced passing point is equal to a scaled score of 600 based on a score range of 200-800 as adopted by the Federation of State Boards of Physical Therapy on February 2, 1993."

Fees established

SECTION 2. Section 40-45-80 of the 1976 Code is amended to read:

"Section 40-45-80. (A) All revenues and income from licenses, fees other than examination fees, sale of commodities and services, and income derived from any other board source or activity must be remitted to the State Treasurer as collected, when practicable, but at least once each week and must be credited to the general fund of the State. All assessments, fees, or licenses must be levied in an amount sufficient to at least equal the amount appropriated in the annual General Appropriations Act for the board, plus any additional funds allocated by the Budget and Control Board for implementation of the state's Personnel Compensation Plan.

(B) The board may charge the following fees in addition to those fees currently set forth in regulation:

(1) an application fee of one hundred twenty dollars;

(2) an examination fee to be paid directly to a third party who has contracted with the Department of Labor, Licensing and Regulation to administer the examination."

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
