TO AMEND SUBARTICLE 11, ARTICLE 13, CHAPTER 7, TITLE 20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CHILD DAY CARE FACILITIES, BY ADDING SECTION 20-7-2725 SO AS TO PROVIDE THAT NO INITIAL LICENSE, APPROVAL, OR REGISTRATION TO OPERATE A PRIVATE DAY CARE CENTER, GROUP DAY CARE HOME, PUBLIC DAY CARE CENTER, FAMILY DAY CARE HOME, CHURCH OR RELIGIOUS DAY CARE CENTER, OR OTHER FACILITY DESCRIBED IN THIS SUBARTICLE ON A REGULAR OR PROVISIONAL BASIS SHALL BE ISSUED UNLESS AND UNTIL THE CRIMINAL BACKGROUND CHECKS REQUIRED BY THIS SUBARTICLE ARE COMPLETED FOR THE APPLICANT AND ALL EMPLOYEES AND CAREGIVERS WHO WILL WORK AT THE FACILITY WHEN IT BEGINS OPERATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Subarticle 11, Article 13, Chapter 7, Title 20 of the 1976 Code is amended by adding:
"Section 20-7-2725. (A) No initial license, approval, or registration to operate a private day care center, group day care home, public day care center, family day care home, church or religious day care center, or other facility described in this subarticle on a regular or provisional basis shall be issued unless and until the criminal background checks required by this subarticle are completed for the applicant and all employees and caregivers who will work at the facility when it begins operation.
(B) No person shall be permitted to work as an employee or caregiver at a private day care center, group day care home, public day care center, family day care home, church or religious day care center or other facility described in this subarticle unless and until the criminal background checks required by this subarticle are completed for that individual.
(C) For purposes of this section, the phrase `initial license, approval, or registration' shall mean the issuance of a license, approval, or registration to an applicant for the first time or to an applicant who has previously been licensed, approved, or registered, but not during the one-year period preceding the application. The phrase `initial license, approval, or registration' does not include the renewal of a license, approval, or registration in effect immediately prior to the application for renewal."
SECTION 2. This act takes effect upon approval by the Governor.
