A CONCURRENT RESOLUTION

TO ESTABLISH A JOINT STUDY COMMITTEE TO STUDY THE TRANSFER OF JURISDICTION TO THE ADMINISTRATIVE LAW JUDGE DIVISION OF CLAIMS BROUGHT PURSUANT TO THE SOUTH CAROLINA TORT CLAIMS ACT.

Be it resolved by the Senate, the House of Representatives concurring:

That a Joint Study Committee be appointed to study the jurisdiction of the Administrative Law Judge Division in order to determine whether there should be a transfer of jurisdiction to the division of cases brought pursuant to the South Carolina Tort Claims Act; and if there is a transfer of jurisdiction, to determine the manner in which and circumstances under which any transfer should be accomplished in this State.

The committee shall consist of eight members as follows:

(1) three members appointed by the Chairman of the House of Representatives Judiciary Committee from the membership of the committee;

(2) three members appointed by the Chairman of the Senate Judiciary Committee from the membership of the committee;

(3) the Chief Judge of the Administrative Law Judge Division or his designee from the division; and

(4) the Director of the Office of Insurance Services.

The staff of the respective committees of the Senate and House shall provide staff support to the Joint Study Committee in the performance of its duties. Committee members shall receive their usual mileage, subsistence, and per diem while on official business of the committee.

The study committee shall report its findings, recommendations, and any suggested changes in state law to the General Assembly no later than January 1, 1999, at which time the study committee shall be dissolved.
