TO AMEND SECTION 59-63-280, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PROHIBITION AGAINST THE POSSESSION OF PAGING DEVICES BY PUBLIC SCHOOL STUDENTS AND THE FORFEITURE OF SUCH PAGING DEVICES AT THE SCHOOL DISTRICT WHERE THEY ARE CONFISCATED, SO AS TO AUTHORIZE EACH SCHOOL DISTRICT BOARD OF TRUSTEES TO TAKE CERTAIN ACTIONS IN REGARD TO THE DISPOSITION OF THESE PAGING DEVICES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 59-63-280 of the 1976 Code, as added by Act 24 of 1991, is amended by adding:
"(E) The board of trustees of each school district shall be authorized to direct its staff, employees, and various schools as to the disposition of paging devices which have been confiscated and forfeited to the school district under this section. These directives may include the destruction of the devices, their sale, or the return of the devices at the beginning of the next school term to the student from whom they were confiscated or his parent, guardian, or custodian upon reasonable proof by the student or his parent, guardian, or custodian of initial purchase or ownership. However, in no event shall the paging device be returned to any student or his parent, guardian, or custodian sooner than six months after it was confiscated and seized."
SECTION 2. This act takes effect upon approval by the Governor.
