A BILL

TO AMEND SECTION 4-5-120, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ANNEXATION OF PART OF ONE COUNTY BY ANOTHER, SO AS TO REQUIRE THE APPROVAL OF THE COUNTY COUNCIL OF THE COUNTY FROM WHICH THE AREA IS PROPOSED TO BE TRANSFERRED WHERE THE AREA TO BE ANNEXED IS LESS THAN FIVE THOUSAND ACRES IN SIZE OR WHERE THE AREA TO BE ANNEXED HAS A POPULATION RATIO OF LESS THAN ONE ELECTOR FOR EACH TEN ACRES.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 4-5-120 of the 1976 Code is amended to read:

"Section 4-5-120. (A) Whenever the governing body of a county by resolution requests that a part of such the county be merged with one or more adjoining counties or whenever ten percent of the registered voters in an area of one county petition in writing that such the area be transferred to another county, the county governing body or the petitioners, as the case may be, shall deposit with the clerk of court of such the county an amount of money sufficient to cover the expenses of surveys and plats and of the annexation commission and the election to be held to determine whether the proposed annexation shall must be effected and shall file such the resolution or petition in the office of the clerk of court of such the county and transmit the petition or resolution to the Governor.

(B) Where the area proposed to be annexed is less than five thousand acres in size or where the area to be annexed has a population ratio of less than one elector for each ten acres, the county governing body of the county from which the area is proposed to be transferred must approve by resolution the annexation petition. A copy of the approving resolution must accompany the petition when the petition is filed in the office of the clerk of court of the county and transmitted to the Governor."

SECTION 2. This act takes effect upon approval by the Governor.
