A BILL

TO AMEND SECTION 22-5-520, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE AMOUNT OF RECOGNIZANCE FOR AN ACCUSED IN MAGISTRATE'S COURT, SO AS TO PROVIDE THAT IF THE DEFENDANT SHALL FAIL TO APPEAR FOR THE TRAIL OR PROCEEDING REGARDING SUCH OFFENSE, THE MAGISTRATE MAY ESCHEAT TO THE AMOUNT OF THE RECOGNIZANCE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 22-5-520 of the 1976 Code is amended to read:

"Section 22-5-520. If the offense charged be is punishable with by a fine and or imprisonment, or either both, the recognizance of the accused entered into before a magistrate shall not be for less than two hundred dollars and in all cases the magistrate taking the recognizance shall cause it to be in such amount as the circumstances may seem to require.

If the defendant shall fail to appear for the trial or proceeding regarding such offense, the magistrate may escheat up to the amount of the recognizance."

SECTION 2. This act takes effect upon approval by the Governor.
