A BILL

TO AMEND SECTION 12-28-2720, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DISTRIBUTION OF GASOLINE TAX REVENUES, SO AS TO DEFINE "PURPOSES OF THE DEPARTMENT" FOR THE USE OF GASOLINE TAX REVENUES BY THE DEPARTMENT OF TRANSPORTATION, SO AS TO DEFINE THESE PURPOSES, AFTER DEDUCTING AMOUNTS FOR ADMINISTRATIVE AND OTHER PROJECTS, TO PROJECTS IN EACH COUNTY BASED ON THE PROPORTION OF TAXABLE FUEL SOLD IN A COUNTY BEARS TO THE TOTAL OF SUCH FUEL SOLD STATEWIDE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 12-28-2720 of the 1976 Code, as last amended by Act 458 of 1996, is further amended by adding a paragraph at the end to read:

"As used in this section, 'purpose of that department' means an amount of the total, not to exceed five percent, for administration or other highway projects of the department and the remainder to be used for departmental purposes in each county of the State based on the proportion of taxable fuel sold in a county to the total of such fuel sold statewide."

SECTION 2. This act takes effect July 1, 1999.
