TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-71-267 SO AS TO PROVIDE THAT A PAYOR OF HEALTH CARE SERVICES MAY NOT INTERFERE WITH THE DECISIONS OF A LICENSED HEALTH CARE PROVIDER UNLESS THE DECISION IS INCONSISTENT WITH SOUND MEDICAL PRACTICE AND TO PROVIDE THAT ALL REMEDIES FOR REDRESSING GRIEVANCES AGAINST PHYSICIANS AND OTHER HEALTH CARE PROVIDERS ARE AVAILABLE AGAINST HEALTH MAINTENANCE ORGANIZATIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 38-71-267. (A) A payor of health care services may not interfere with the patient evaluation, diagnostic, or treatment decisions of a physician or other licensed health care provider unless the decision is inconsistent with sound medical practice.
(B) All legal remedies that are available to patients to redress grievances against physicians and other health care providers are available to patients to redress grievances against health maintenance organizations that provide coverage to patients."
SECTION 2. This act takes effect upon approval by the Governor.
