TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-6-94 SO AS TO PROVIDE THAT THE DEPARTMENT OF PUBLIC SAFETY OR ANY GOVERNMENT ENTITY SHALL NOT SELL CERTAIN INFORMATION CONTAINED IN A PERSON'S DRIVER'S LICENSE RECORD UNLESS THE PERSON AUTHORIZES THE SALE, TO PROVIDE THAT THE DEPARTMENT MUST REFUND ALL MONEY RECEIVED FROM THE SALE OF THIS INFORMATION AND TO PROVIDE THAT THE USE OF THIS INFORMATION IS RESTRICTED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 23-6-94. (A) The Department of Public Safety or any government entity shall not sell copies of photography, electronically stored information, stored photographs, or digitized images contained in a person's driver's license record unless the person authorizes its sale.
(B) The department must refund to purchasers of copies of photography, electronically stored information, stored photographs, or digitized images contained in a person's driver's license record all money collected for purchases that occurred before the effective date of this act.
(C) A person may not use the information contained in subsection (A) for commercial or personal purposes which include end-use retailers who seek to purchase photographs unless authorized by the driver."
SECTION 2. This act takes effect upon approval by the Governor.
