A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 2-7-79 SO AS TO PROVIDE THAT THE GENERAL ASSEMBLY ANNUALLY IN THE GENERAL APPROPRIATIONS ACT, IN A SUPPLEMENTAL APPROPRIATIONS ACT, OR IN A BOND OR CAPITAL RESERVE FUND BILL SHALL APPROPRIATE OR AUTHORIZE FUNDS EQUAL TO ONE-TENTH OF THE STATE'S TOTAL ESTIMATED COST OF ITS K-12 SCHOOL BUS FLEET, AND TO PROVIDE THAT THESE FUNDS SHALL BE RETAINED IN A SPECIAL ACCOUNT TO BE USED SOLELY FOR THE PURPOSE OF ACQUIRING SUFFICIENT SCHOOL BUSES FOR THE K-12 SCHOOL BUS FLEET.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 2-7-79. The General Assembly annually in the general appropriations act, in a supplemental appropriations act, or in a bond or capital reserve fund bill shall appropriate or authorize funds equal to one-tenth of the state's total estimated cost of its K-12 school bus fleet as determined by the State Department of Education in conjunction with the State Budget Office. The K-12 school bus fleet shall include buses for the South Carolina School for the Deaf and the Blind. The funds derived from this appropriation or authorization shall be retained by the Department of Education in a special account to be used solely for the purpose of acquiring sufficient school buses for the K-12 school bus fleet. Funds in this special account may be carried forward from year to year and any income thereon shall be retained in the special fund and used for its stated purposes.

Nothing herein prevents the General Assembly from appropriating or authorizing additional funds for the purchase of school buses as the need arises."

SECTION 2. This act takes effect upon approval by the Governor.
