A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 9-1-1605 SO AS TO PROVIDE THAT THE LIMITATION ON THE AMOUNT OF EARNINGS IN A FISCAL YEAR A RETIREE MAY RECEIVE FROM A COVERED EMPLOYER UNDER THE SOUTH CAROLINA RETIREMENT SYSTEM WITHOUT THE LOSS OF RETIREMENT BENEFITS DOES NOT APPLY TO THE EARNINGS A RETIRED TEACHER WHO IS CERTIFIED TO TEACH IN THIS STATE RECEIVES WHILE WORKING AS A CLASSROOM TEACHER IN AN ELEMENTARY OR SECONDARY PUBLIC SCHOOL OF THIS STATE AFTER RETIREMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 9-1-1605. (A) Notwithstanding any other provision of law, the limitation on the amount of earnings in any fiscal year a retiree may receive from a covered employer under the South Carolina Retirement System without the loss of retirement benefits does not apply to the earnings a retired teacher who is certified to teach in South Carolina receives while working as a classroom teacher in an elementary or secondary public school of this State after retirement.

(B) The provisions of this section are supplemental and in addition to the provisions of Section 9-1-1600."

SECTION 2. This act takes effect upon approval by the Governor.
