TO AMEND SECTION 16-23-465, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO UNLAWFULLY CARRYING A PISTOL OR FIREARM ONTO THE PREMISES OF A BUSINESS SELLING ALCOHOLIC LIQUOR, BEER, OR WINE FOR ON-PREMISES CONSUMPTION, SO AS TO PROVIDE THAT A PERSON WITH A CONCEALABLE WEAPON PERMIT MAY CARRY THE CONCEALABLE WEAPON ONTO THE PREMISES IF THE PERSON IS NOT UNDER THE INFLUENCE OF ALCOHOL OR CONTROLLED SUBSTANCES, THE PERSON DOES NOT CONSUME ALCOHOL, BEER, OR WINE WHILE ON THE PREMISES, AND THE PREMISES IS NOT POSTED TO PROHIBIT THE CARRYING OF CONCEALABLE WEAPONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 16-23-465 of the 1976 Code, as last amended by Act 464 of 1996, is further amended to read:
"Section 16-23-465. (A) In addition to the penalties provided for by Sections 16-11-330 and 16-23-460 and by Article 1 of Chapter 23 of Title 16, a person convicted of carrying a pistol or firearm onto the premises of a business which sells alcoholic liquor, beer, or wine for consumption on the premises is guilty of a misdemeanor and, upon conviction, must be fined not more than two thousand dollars or imprisoned not more than three years, or both.
(B) It is not a violation of this section for a person licensed to carry a concealable weapon pursuant to Article 4, Chapter 31, Title 23 to carry a concealable weapon onto the premises of a business which sells alcoholic liquor, beer, or wine for consumption on the premises provided:
(1) the person is not under the influence of alcohol or a controlled substance;
(2) the person does not consume alcoholic liquor, beer, or wine on the premises; and
(3) the owner or person in legal possession or control of the premises has not posted a sign prohibiting the carrying of a concealable weapon upon the premises.
(C) In addition to the penalties described above, a person who violates this section while carrying a concealable weapon pursuant to Article 4, Chapter 31, Title 23 must have his concealed weapon permit revoked."
SECTION 2. This act takes effect upon approval by the Governor.
