TO AMEND SECTIONS 1-11-25 AND 1-11-26, CODE OF LAWS OF SOUTH CAROLINA, 1976 CODE, RELATING TO THE ESTABLISHMENT OF THE LOCAL GOVERNMENT DIVISION OF THE STATE BUDGET AND CONTROL BOARD AND THE USE OF GRANT FUNDS, SO AS TO CHANGE ITS NAME TO THE OFFICE OF LOCAL GOVERNMENT, PROVIDE THAT ITS DIRECTOR REPORTS DIRECTLY TO THE STATE BUDGET AND CONTROL BOARD, AND UPDATE REFERENCES TO AGENCIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 1-11-25 of the 1976 Code is amended to read:
"Section 1-11-25. There is hereby established a an Office of Local Government Division within the State Budget and Control Board to act as a liaison for financial grants among local governments, the General Assembly, and the Governor's Office. The division shall be office is under the supervision of a director who shall be appointed by and who shall serve serves at the pleasure of the State Budget and Control Board and whose compensation shall be as is provided for by the General Assembly. The director reports directly to the board in the performance of his duties. He may employ such staff as may be approved by the board. The division shall be office is responsible for certifying grants to local governments from both federal and state funds. The term 'local government' shall mean means any political entity below the state level.
The division office shall establish guidelines and procedures which local governments shall follow in applying for grants certified by the division office. The director shall make known to local governments the availability of all grants available through the division office and shall make periodic reports to the Budget and Control board, the General Assembly, and the Governor's Office. The reports shall contain information concerning the amount of funds available from both federal and state sources, requests for grants, and the status of such the requests and such other information as the director may deem considers appropriate. The director shall maintain such records as may be necessary for the efficient operation of the office.
The Division of Administration appropriate entity in the Governor's Office, under contractual agreement, shall furnish the Office of Local Government Division such accounting service support as may be requested."
SECTION 2. Section 1-11-26 of the 1976 Code, as added by Act 612 of 1990, is amended to read:
"Section 1-11-26. (A) Grant funds received by a county, municipality, political subdivision, or other entity from the Division Office of Local Government of the State Budget and Control Board must be deposited in a separate fund and may not be commingled with other funds, including other grant funds. Disbursements may be made from this fund only on the written authorization of the individual who signed the grant application filed with the division, or his successor, and only for the purposes specified in the grant application. A person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined five thousand dollars or imprisoned for six months, or both.
(B) It is not a defense to an indictment alleging a violation of this section that grant funds received from the Division Office of Local Government were used by a grantee or subgrantee for governmental purposes other than those specified in the grant application or that the purpose for which the grant was made by the Division Office of Local Government was accomplished by funds other than grant funds.
(C) The Division Office of Local Government of the State Budget and Control Board shall furnish a copy of this section to a grantee when the grant is awarded."
SECTION 3. This act takes effect upon approval by the Governor.
