To whom was referred a Bill (S. 131), to amend the Code of Laws of South Carolina, 1976, by adding Section 56-5-3905 so as to prohibit persons under fifteen years of age from standing or sitting in the open bed of a pickup truck, etc., respectfully

STATEMENT OF ESTIMATED FISCAL IMPACT

ESTIMATED FISCAL IMPACT ON GENERAL FUND EXPENDITURES IS:

EXPLANATION OF IMPACT:

There would no impact on the General Fund of the State nor on federal and/or other funds.

SPECIAL NOTES:

Upon conviction the operator of the vehicle must be fined up to $25, therefore, pursuant to Section 2-7-71 of the 1976 South Carolina Code of Laws the Board of Economic Advisors is the appropriate agency to address any revenue impact of this legislation.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-3905 SO AS TO PROHIBIT PERSONS UNDER FIFTEEN YEARS OF AGE FROM STANDING OR SITTING IN THE OPEN BED OF A PICKUP TRUCK OR TRAILER UNDER CERTAIN CIRCUMSTANCES, AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 56-5-3905. (A) It is unlawful for a person under fifteen years of age to stand or sit in the open bed of a pickup truck or trailer while it is traveling in excess of twenty-five miles an hour on a public road or highway.

(B) Subsection (A) does not apply when the vehicle is being:

(1) used for hunting;

(2) operated in an agricultural enterprise; or

(3) operated in an organized hay ride or parade.

(C) The operator of a motor vehicle who permits a person under fifteen years of age to ride in the open bed of a pickup truck or trailer in violation of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than twenty-five dollars or imprisoned not more than thirty days, or both."

SECTION 2. This act takes effect upon approval by the Governor.
