A BILL

TO AMEND ARTICLE 11, CHAPTER 5, TITLE 50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SHRIMP, BY ADDING SECTIONS 50-5-1102, SO AS TO PROVIDE THAT, EFFECTIVE JULY 1, 2000, NO PERSON LICENSED AS A COMMERCIAL SALTWATER FISHERMAN OR AS A WHOLESALE SEAFOOD DEALER MAY OBTAIN A SHRIMP BAITING LICENSE, AND 50-5-1110, SO AS TO PROVIDE THAT, EFFECTIVE JULY 1, 2002, WHEN TAKING SHRIMP OVER BAIT NO CAST NET MAY BE USED HAVING A MESH SIZE SMALLER THAN ONE-HALF INCH SQUARE MEASURE OR ONE INCH STRETCH MEASURE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 11, Chapter 5, Title 50 of the 1976 Code, as added by an act of 2000, bearing ratification number R. 253 of 2000, is amended by adding:

"Section 50-5-1102. Effective July 1, 2000, no person licensed as a commercial saltwater fisherman or as a wholesale seafood dealer may obtain a shrimp baiting license."

SECTION 2. Article 11, Chapter 5, Title 50 of the 1976 Code, as added by an act of 2000 bearing ratification number R. 253 of 2000, is amended by adding:

"Section 50-5-1110. Effective July 1, 2002, when taking shrimp over bait no cast net may be used having a mesh size smaller than one-half inch square measure or one inch stretch measure."

SECTION 3. Except as otherwise specifically provided in this act, this act takes effect upon approval by the Governor.
