To whom was referred a Bill (H. 3833), to amend the Code of Laws of South Carolina, 1976, by adding Section 12-54-75 so as to provide for electronic collection of revenues by a state agency, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, Section 12-54-75(A), SECTION 1, page 1, line 26, by deleting /or credit/.

When amended Section 12-54-75(A) reads:

"(A) The State Treasurer may authorize a state agency which collects revenues, either as taxes or license fees or as payment for goods or services, to accept electronic forms of payment including, but not limited to, debit cards, bank debits or credits, or electronic purse options. These electronic payments may be accepted in the course of an electronic commerce transaction, in which the business transaction is conducted by means of the internet, interactive voice response, or other fully electronic means. /

Amend title to conform.

STATEMENT OF ESTIMATED FISCAL IMPACT

REVENUE IMPACT1

This bill is expected to increase revenue not included in the general fund revenue by a negligible amount in FY1999-00.

Explanation

This bill would allow a state agency that collects taxes, license fees, or payments for goods and services via electronic means to charge and retain a processing fee. The processing fee would be negotiated by the State Treasurer on behalf of the state agency and used as payment to service providers. These "fees" would be designated as "Other Funds" and would therefore, not affect general fund revenue in FY1999-00.

1/ This statement meets the requirement of Section 2-7-71 for a state revenue impact, Section 2-7-76 for a local revenue impact, and Section 6-1-85(B) for an estimate of the shift in local property tax incidence.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 12-54-75 SO AS TO PROVIDE FOR ELECTRONIC COLLECTION OF REVENUES BY A STATE AGENCY PURSUANT TO A CONTRACT NEGOTIATED AND ENTERED INTO BY THE STATE TREASURER ON BEHALF OF THE AGENCY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 12-54-75. (A) The State Treasurer may authorize a state agency which collects revenues, either as taxes or license fees or as payment for goods or services, to accept electronic forms of payment including, but not limited to, debit or credit cards, bank debits or credits, or electronic purse options. These electronic payments may be accepted in the course of an electronic commerce transaction, in which the business transaction is conducted by means of the internet, interactive voice response, or other fully electronic means.

(B) The State Treasurer may contract on behalf of the agencies with payment service providers for the processing of electronic payments, and may negotiate associated processing fees. The agency collecting revenues electronically may withhold the negotiated processing fees for payment to service providers from the revenues collected."

SECTION 2. This act takes effect upon approval by the Governor.
