THE COMMITTEE ON EDUCATION

To whom was referred a Bill (S. 488), to amend Chapter 101, Title 59 of the Code of Laws of South Carolina, 1976, relating to colleges and institutions of higher learning, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by deleting Lines 30 through 41 and inserting the following:

/ "Section 59-101-187. Costs associated with events and meetings at colleges, universities and technical colleges honoring or recognizing students, distinguished guests, faculty and employees may be paid by the institution. The institution's governing board shall establish policies for the expenditure of funds for these events and meetings. The expenditure of monies under the limits of these written policies shall be considered to meet the public purpose test for the expenditure of public funds." /

Renumber sections to conform.

Amend title to conform.

A BILL

TO AMEND CHAPTER 101, TITLE 59 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO COLLEGES AND INSTITUTIONS OF HIGHER LEARNING, BY ADDING SECTION 59-101-187, SO AS TO PROVIDE THAT A GOVERNING BOARD OF A STATE SUPPORTED COLLEGE, UNIVERSITY, OR TECHNICAL SCHOOL IS AUTHORIZED TO ESTABLISH WRITTEN POLICIES FOR THE EXPENDITURE OF PUBLIC FUNDS FOR EVENTS WHICH RECOGNIZE ACADEMIC AND RESEARCH EXCELLENCE AND NOTEWORTHY ACCOMPLISHMENTS OF MEMBERS, STUDENTS, AND DISTINGUISHED GUESTS OF ITS INSTITUTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 101, Title 59 of the 1976 Code is amended by adding:

"Section 59-101-187. The governing boards of all state supported colleges, universities, and technical schools are authorized to establish written policies for the expenditure of public funds on administrative, faculty, employee, student and distinguished guest events, including, but not limited to, meals and similar types of recognition to acknowledge, reward or to otherwise honor academic and research excellence, noteworthy accomplishments or other purposes that enhance the quality of the academic experience, the mission, and the reputation of the college, university or technical college. The expenditure of monies under the limits of these written policies shall be considered to best meet the public purpose for the expenditure of public funds."

SECTION 2. This act takes effect upon approval by the Governor.
