A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-6-120 SO AS TO PROHIBIT REQUIRING PRIOR AUTHORIZATION OR OTHER RESTRICTIONS ON MEDICAID RECIPIENTS FOR ATYPICAL ANTIPSYCHOTIC MEDICATIONS USED TO TREAT MENTAL ILLNESS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 44-6-120. Notwithstanding any other provision of law, a requirement to obtain prior authorization, or any other restriction, for atypical antipsychotic medications used to treat mental illness may not be imposed on Medicaid recipients."

SECTION 2. This act takes effect upon approval by the Governor.
