A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 24-13-240 SO AS TO ALLOW CERTAIN PRISONERS A REDUCTION IN THEIR SENTENCES IF THEY BECOME ORGAN OR TISSUE DONORS .

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 24-13-240. (A) A person who has not been convicted of a 'no parole offense', sentenced to death or to a term of life imprisonment, and is in the custody of the Department of Corrections or a local facility pursuant to a designated facility agreement authorized by Section 24-3-30, is entitled to have his sentence reduced by one-third if he becomes an organ or tissue donor.

(B) The reduction in sentence contained in subsection (A) must be calculated without the application of earned work credits, education credits, or good conduct credits, and must be applied to the actual term of imprisonment imposed, not including any portion of the sentence which has been suspended."

SECTION 2. This act takes effect upon approval by the Governor.
