A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-77-290 SO AS TO REQUIRE AN INSURED TO BE PAID AN AMOUNT TO COVER ANY LOSS IN VALUE TO AN AUTOMOBILE THAT RESULTED FROM THE AUTOMOBILE HAVING BEEN DAMAGED AND REPAIRED IF THE INSURED WAS NOT AT FAULT FOR THE PROPERTY DAMAGE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The 1976 Code is amended by adding:

    "Section 38-77-290.    In addition to any claims paid to repair property damage on an individual private passenger automobile, the insured, if not at fault for the property damage, must be paid an amount sufficient to cover any loss in value to the automobile resulting from the automobile having been damaged and repaired."

SECTION    2.    This act takes effect upon approval by the Governor.
