A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-1080 SO AS TO PROVIDE THAT A PERSON OR BUSINESS COMMITS THE OFFENSE OF FURNISHING FALSE CREDIT INFORMATION IF THE PERSON OR BUSINESS KNOWINGLY FURNISHES FALSE INFORMATION ABOUT ANOTHER PERSON'S CREDITWORTHINESS, CREDIT STANDING, OR CREDIT CAPACITY TO A CREDIT REPORTING BUREAU, TO PROVIDE THAT A CREDIT REPORTING BUREAU COMMITS THE OFFENSE OF FURNISHING FALSE CREDIT INFORMATION IF THE CREDIT REPORTING BUREAU KNOWINGLY FURNISHES FALSE INFORMATION ABOUT A PERSON'S CREDITWORTHINESS, CREDIT STANDING, OR CREDIT CAPACITY TO A THIRD PARTY, AND TO PROVIDE A PENALTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The 1976 Code is amended by adding:

    "Section 16-3-1080.    (A)    A person or business commits the offense of furnishing false credit information if the person or business knowingly furnishes false information about another person's creditworthiness, credit standing, or credit capacity to a credit reporting bureau.

    (B)    A credit reporting bureau commits the offense of furnishing false credit information if the credit reporting bureau knowingly furnishes false information about a person's creditworthiness, credit standing, or credit capacity to a third party.

    (C)    A person or business that violates a provision contained in this section must be fined not more than two thousand dollars."

SECTION    2.    This act takes effect upon approval by the Governor.
