PROPOSING AN AMENDMENT TO SECTION 36, ARTICLE III, OF THE CONSTITUTION OF SOUTH CAROLINA, 1895, RELATING TO CONSTITUTIONAL RESERVE FUNDS, SO AS TO PROVIDE THAT ONE PURPOSE FOR WHICH CAPITAL RESERVE FUND APPROPRIATIONS MAY BE EXPENDED SHALL BE FOR CAPITAL IMPROVEMENTS OF STATE AGENCIES, DEPARTMENTS, OR INSTITUTIONS ONLY FOR THE ACQUISITION OR IMPROVEMENT OF REAL PROPERTY OR FOR OTHER NONRECURRING EMERGENCY PURPOSES AS A RESULT OF NATURAL DISASTERS OR CATASTROPHES INSTEAD OF FOR GENERAL CAPITAL IMPROVEMENTS AND NONRECURRING PURPOSES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. It is proposed that Section 36(B)(2)(c) of Article III of the Constitution of this State be amended to read:
"(c) for capital improvements of state agencies, departments, or institutions only for the acquisition or improvement, or both, of real property or for other nonrecurring emergency purposes as a result of natural disasters or catastrophes."
SECTION 2. The proposed amendment must be submitted to the qualified electors at the next general election for representatives. Ballots must be provided at the various voting precincts with the following words printed or written on the ballot:
"Must Section 36 of Article III of the Constitution of this State, relating to constitutional reserve funds be amended so as to provide that one purpose for which capital reserve fund appropriations may be expended shall be for capital improvements of state agencies, departments, or institutions only for the acquisition or improvement of real property or for other nonrecurring emergency purposes as a result of natural disasters or catastrophes instead of for general capital improvements and nonrecurring purposes?
Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word 'Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word 'No'."
