TO AMEND SECTION 37-5-108, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO UNCONSCIONABILITY OF CONSUMER CREDIT CONTRACTS AND LIMITATIONS ON A CREDITOR'S COLLECTION REMEDIES SO AS TO PROHIBIT COLLECTION TELEPHONE CALLS FROM MIDNIGHT FRIDAY THROUGH MIDNIGHT SUNDAY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 37-5-108(5)(b)(i) of the 1976 Code, as last amended by Act 135 of 1995, is further amended to read:
"(i) communicate with a consumer at any unusual time or place known or which should be known to be inconvenient to the consumer. In the absence of knowledge of circumstances to the contrary, it may be assumed that a convenient time to communicate with a consumer is between 8 a.m. and 9 p.m. on Monday through Friday, and never from midnight Friday until midnight Sunday; or"
SECTION 2. This act takes effect upon approval by the Governor.
