TO AMEND CHAPTER 3, TITLE 5, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CHANGE IN CORPORATE LIMITS OF A MUNICIPALITY, BY ADDING SECTION 5-3-283 SO AS TO PROVIDE A PROCEDURE FOR THE REMOVAL OF AN AREA WHICH HAS BEEN ANNEXED BY ANOTHER MUNICIPALITY AND FORMERLY CONTAINED IN A DISSOLVED MUNICIPALITY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 3, Title 5, of the 1976 Code is amended by adding:
"Section 5-3-283. (A) Territory which was formerly contained within a municipality which has been dissolved and has been annexed by another municipality may be removed from that municipality by complying with the provisions of this section.
(B) A petition containing the signatures of seventy-five percent of freeholders owning seventy-five percent of the assessed value of the territory proposed to be removed from the municipality may be presented to the governing body of the municipality in which the territory is located.
(C) The governing body of the municipality to which the petition is presented must, within sixty days, adopt an ordinance removing the territory described in the petition from the corporate limits of the municipality."
SECTION 2. This act takes effect upon approval by the Governor.
