TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-101-385 SO AS TO PROVIDE THAT ANY FULL-TIME OR PART-TIME STUDENT OF A PUBLIC OR PRIVATE COLLEGE, UNIVERSITY, OR TECHNICAL SCHOOL OF THIS STATE, WHO IS A MEMBER OF A RESERVE COMPONENT OF THE ARMED FORCES OF THE UNITED STATES OR A NATIONAL GUARD UNIT OF THIS STATE OR ANY OTHER STATE AND WHO IS CALLED TO ACTIVE DUTY FOR A PERIOD OF MORE THAN FIFTEEN DAYS DUE TO A STATE OR NATIONAL EMERGENCY IS ENTITLED TO A FULL REFUND OF ALL TUITION AND FEES PAID FOR THE SEMESTER OR QUARTER HE IS CALLED TO ACTIVE DUTY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-101-385. Any full-time or part-time student of a public or private college, university, or technical school of this State, who is a member of a reserve component of the Armed Forces of the United States or a National Guard unit of this State or any other state and who is called to active duty for a period of more than fifteen days due to a state or national emergency is entitled at his option to a full refund of all tuition and fees paid for the semester or quarter during which he is called to active duty.
The college, university, or technical school may require appropriate verification of the student's active duty assignment including a copy of the student's military orders if available."
SECTION 2. This act takes effect upon approval by the Governor.
