TO AMEND SECTION 1-11-720, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO GOVERNMENTAL ENTITIES WHOSE EMPLOYEES AND RETIREES ARE ELIGIBLE TO PARTICIPATE IN THE STATE HEALTH AND DENTAL INSURANCE PLAN, SO AS TO PROVIDE THAT A RESIDENTIAL GROUP CARE FACILITY PROVIDING ON-SITE TEACHING FOR RESIDENTS IS ELIGIBLE IF EITHER ITS EMPLOYEES ARE CURRENTLY MEMBERS OF THE SOUTH CAROLINA RETIREMENT SYSTEM OR IF IT PROVIDES AT NO COST EDUCATIONAL FACILITIES ON ITS GROUNDS TO THE SCHOOL DISTRICT IN WHICH IT IS LOCATED RATHER THAN BOTH OF THESE REQUIREMENTS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 1-11-720(A)(11) of the 1976 Code, as added by Act 458 of 1996, is amended to read:
"(11) a residential group care facility providing on-site teaching for residents if:
(a) the facility's staff are currently members of the South Carolina Retirement System established pursuant to Chapter 1, Title 9 and; or
(b) if it provides at no cost educational facilities on its grounds to the school district in which it is located."
SECTION 2. This act takes effect upon approval by the Governor.
