A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 48-1-89 SO AS TO PROVIDE THAT A WHOLE EFFLUENT TOXICITY (WET) TEST RESULT THAT DEVIATES FROM WATER QUALITY STANDARDS ENFORCED BY THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL DOES NOT CONSTITUTE A VIOLATION WITHOUT EVIDENCE OF OTHER WATER QUALITY STANDARD DEVIATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The 1976 Code is amended by adding:

    "Section 48-1-89.    Notwithstanding any other provision of law, a whole effluent toxicity (WET) test result that deviates from water quality standards required by the department does not in and of itself constitute a violation without evidence of other water quality standard deviations."

SECTION    2.    This act takes effect upon approval by the Governor.
