TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 48-1-115 SO AS TO REQUIRE A PERSON PETITIONING THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL FOR A PUBLIC HEARING ON AN APPLICATION FOR AN ONSITE WASTEWATER SYSTEM IN A NEW SUBDIVISION TO RESIDE OR OWN PROPERTY WITHIN FIVE HUNDRED YARDS OF THE SUBDIVISION AND MUST STATE HOW THE APPROVAL OF THE WASTEWATER SYSTEM WOULD NEGATIVELY IMPACT HIM.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 48-1-115. (A) Notwithstanding any other provision of law, when the Department of Health and Environmental Control has given public notice of an application to approve an onsite wastewater system as the method of sewage treatment and disposal in a new subdivision, a person filing a petition for a public hearing during the fifteen-day public comment period must reside or own property within five hundred yards of the subdivision and must state how the approval of the wastewater system would impact him specifically.
(B) For purposes of this section:
(1) 'Onsite wastewater system' means a sewage treatment and disposal system or any part of a system, designed to treat and dispose of, or store sewage including, but not limited to, septic tank systems, sewage holding systems, and similar devices.
(2) 'Subdivision' means a tract or parcel of land that is subdivided into two or more lots for the immediate or future purpose of building development and applies whether the lots are to be sold, rented, or leased."
SECTION 2. This act takes effect upon approval by the Governor.
