A BILL

TO AMEND CHAPTER 13, TITLE 16, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO FORGERY, LARCENY, EMBEZZLEMENT, FALSE PRETENSES, AND CHEATS, BY ADDING SECTION 16-13-480 SO AS TO PROVIDE THAT IN A CRIMINAL PROCEEDING BROUGHT PURSUANT TO THIS CHAPTER, THE CRIME IS CONSIDERED TO HAVE BEEN COMMITTED IN A COUNTY IN WHICH A PART OF THE OFFENSE TOOK PLACE, REGARDLESS OF WHETHER THE DEFENDANT WAS EVER ACTUALLY IN THAT COUNTY; AND TO AMEND CHAPTER 11, TITLE 34, BY ADDING SECTION 34-11-55 SO AS TO PROVIDE THAT IN A CRIMINAL PROCEEDING BROUGHT PURSUANT TO THIS CHAPTER, THE CRIME IS CONSIDERED TO HAVE BEEN COMMITTED IN A COUNTY IN WHICH A PART OF THE OFFENSE TOOK PLACE, REGARDLESS OF WHETHER THE DEFENDANT WAS EVER ACTUALLY IN THAT COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 13, Title 16 of the 1976 Code is amended by adding:

    "Section 16-13-480.    In a criminal proceeding brought pursuant to this chapter, the crime is considered to have been committed in a county in which a part of the offense took place, regardless of whether the defendant was ever actually in that county."

SECTION 2.    Chapter 11, Title 34 of the 1976 Code is amended by adding:

    "Section 34-11-55.    In a criminal proceeding brought pursuant to this chapter, the crime is considered to have been committed in a county in which a part of the offense took place, regardless of whether the defendant was ever actually in that county."

SECTION    3.    This act takes effect upon approval by the Governor.
