A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 15-1-340 SO AS TO PROVIDE THAT A PSYCHOLOGIST APPOINTED BY FAMILY COURT FOR A CUSTODY EVALUATION, THE COURT OF COMMON PLEAS, OR PROBATE COURT IS IMMUNE FROM CIVIL LIABILITY FOR ANY ACT OR OMISSION COMMITTED WITHIN THE SCOPE OF THE COURT ORDERED APPOINTMENT AND TO PROVIDE EXCEPTIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 15-1-340. A psychologist appointed by the family court for a custody evaluation, court of common pleas, or probate court is immune from civil liability for any act or omission committed within the scope of the court ordered appointment unless the psychologist acted or failed to act in a reckless or grossly negligent manner or with intentional misconduct, and the reckless or grossly negligent conduct or intentional misconduct was the proximate cause of the injury or damage alleged."

SECTION 2. This act takes effect upon approval by the Governor and applies to acts or omissions occurring on or after that date.
