TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 2-1-35 SO AS TO ESTABLISH ELECTION DISTRICTS FROM WHICH MEMBERS OF THE HOUSE OF REPRESENTATIVES ARE ELECTED COMMENCING WITH THE 2002 GENERAL ELECTION, TO DESIGNATE THE HOUSE OF REPRESENTATIVES AS THE SUBMITTING AUTHORITY TO MAKE THE REQUIRED SUBMISSION OF THE HOUSE REAPPORTIONMENT PLAN TO THE UNITED STATES DEPARTMENT OF JUSTICE UNDER THE VOTING RIGHTS ACT; TO REPEAL SECTION 2-1-25 RELATING TO ELECTION DISTRICTS FROM WHICH MEMBERS OF THE HOUSE OF REPRESENTATIVES WERE FORMERLY ELECTED; TO ADD SECTION 2-1-75 SO AS TO ESTABLISH ELECTION DISTRICTS FROM WHICH MEMBERS OF THE SOUTH CAROLINA SENATE ARE ELECTED COMMENCING WITH THE 2004 GENERAL ELECTION, TO DESIGNATE THE PRESIDENT PRO TEMPORE OF THE SENATE AS THE SUBMITTING AUTHORITY TO MAKE THE REQUIRED SUBMISSION OF THE SENATE REAPPORTIONMENT PLAN TO THE UNITED STATES DEPARTMENT OF JUSTICE UNDER THE VOTING RIGHTS ACT; TO REPEAL SECTION 2-1-65 RELATING TO ELECTION DISTRICTS FROM WHICH MEMBERS OF THE SENATE WERE FORMERLY ELECTED; TO AMEND SECTION 7-19-40, AS AMENDED, RELATING TO CONGRESSIONAL DISTRICTS, SO AS TO REAPPORTION AND FURTHER PROVIDE FOR THE COMPOSITION OF THE DISTRICTS IN ACCORDANCE WITH THE UNITED STATES CENSUS OF 2000; AND TO JOINTLY DESIGNATE THE PRESIDENT PRO TEMPORE OF THE SENATE AND THE SPEAKER OF THE HOUSE OF REPRESENTATIVES AS THE APPROPRIATE OFFICIALS OF THE SUBMITTING AUTHORITY TO MAKE THE REQUIRED SUBMISSION OF THE CONGRESSIONAL REAPPORTIONMENT PLAN TO THE UNITED STATES DEPARTMENT OF JUSTICE UNDER THE VOTING RIGHTS ACT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 2-1-35. Commencing with the 2002 general election, one representative of the House of Representatives must be elected from each of the following districts:
SECTION 2. Section 2-1-25 of the 1976 Code is repealed effective with the 2002 general election.
SECTION 3. Upon the effective date of this act and pursuant to 28 CFR Section 51.23, the House of Representatives is designated the submitting authority to make the required submission to the United States Department of Justice under Section 5 of the Voting Rights Act, as amended, 42 U.S.C. 1973a, of the House of Representatives' reapportionment plan set forth in Section 2-1-35.
SECTION 4. The 1976 Code is amended by adding:
"Section 2-1-75. Commencing with the 2004 general election, one member of the Senate must be elected from each of the following districts:
SECTION 5. Section 2-1-65 of the 1976 Code is repealed effective with the 2004 general election.
SECTION 6. Upon the effective date of this act, the President Pro Tempore of the South Carolina Senate is designated as the appropriate official of the submitting authority who is responsible for making submissions of the revised Senate election districts set forth in Section 2-1-75 to the Chief, Voting Section, Civil Rights Division, Department of Justice, in compliance with Section 5 of the Voting Rights Act of 1965, as amended, and Title 28, Part 51 of the Code of Federal Regulations.
SECTION 7. Section 7-19-40 of the 1976 Code, as last amended by Act 321 of 1994, is further amended to read:
"Section 7-19-40. The State is hereby divided into six congressional districts, as follows:
SECTION 8. Upon the effective date of this act, the Speaker of the South Carolina House of Representatives and the President Pro Tempore of the South Carolina Senate are jointly designated as the appropriate officials of the submitting authority who are responsible for making submissions of the congressional reapportionment plan set forth in Section 7-19-40 to the Chief, Voting Section, Civil Rights Division, Department of Justice in compliance with Section 5 of the Voting Rights Act of 1965, as amended, and Title 28, Part 51 of the Code of Federal Regulations.
SECTION 9. This act takes effect upon approval by the Governor.
