STATEMENT OF ESTIMATED FISCAL IMPACT

REVENUE IMPACT1

    This bill is expected to increase motor vehicle license revenues within the general fund by $19,680 in FY 2001-02. This bill is expected to increase funds allocated to the State Highway Fund within the Department of Transportation by $1,920 in FY 2001-02.

Explanation

    This bill provides for the Department of Public Safety (DPS) to issue a special license plate to members of Ducks Unlimited. A minimum of 400 paid applications from certified members or a deposit of $4,000 and a marketing plan approved by DPS is required for production. A member may purchase a plate for private vehicles licensed in his or her name. The plate will cost $54. The new, special plate fee is $30 biennially in addition to the regular $24 registration fee.

    Based on prior sales of fraternal/professional organizations, the BEA expects first-year revenues from special plate fees to be $12,000. This figure is based on applications by 400 members at $30 each. Pursuant to Section 56-3-920(A), the special plate fee of $30 is credited to the general fund. Pursuant to Section 56-3-910(B), 80% of the regular $24 biennial registration fee is credited to the general fund and 20% to the State Highway Fund of the Department of Transportation. Multiplying 400 times $24 would yield $9,600 of which $7,680 is general fund and $1,920 is Highway Fund. This bill, therefore, is expected to increase general fund revenue by a total of $19,680 and State Highway Fund revenue by $1,920 in FY 2001-02. This bill would have no impact on State Infrastructure Bank revenues since it does not apply to fees required under Sections 56-3-660 and 56-3-670.

A BILL

TO AMEND CHAPTER 3, TITLE 56, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO REGISTRATION AND LICENSING OF MOTOR VEHICLES, BY ADDING ARTICLE 86 SO AS TO PROVIDE FOR DUCKS UNLIMITED SPECIAL LICENSE PLATES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 3, Title 56, of the 1976 Code is amended by adding:

"Article 86

Ducks Unlimited Special License Plates

    Section 56-3-8500.    (A)    The Department of Public Safety may issue special motor vehicle license plates to members of Ducks Unlimited for private motor vehicles registered in their names. The fee for this special license plate must be the regular motor vehicle license fee contained in Article 5, Chapter 3 of this title which must be deposited in the state general fund and the special fee required by Section 56-3-2020 which must be deposited with the department. The license plates issued pursuant to this section must conform to a design agreed to by the department and the chief executive officer of the organization.

    (B)    Before the Department of Public Safety produces and distributes a special license plate pursuant to this section, it must receive:

        (1)    four hundred prepaid applications for the special license plate or a deposit of four thousand dollars from the individual or organization seeking issuance of the license plate. If a deposit of four thousand dollars is made by an individual or organization pursuant to this section, the department must refund the four thousand dollars once an equivalent amount of license plate fees is collected for that organization's license plate. If the equivalent amount is not collected within four years of the first issuance of the license plate, then the department must retain the deposit; and

        (2)    a plan to market the sale of the special license plate which must be approved by the department.

    (C)    If the department receives less than three hundred biennial applications and renewals for a particular special license plate, it shall not produce additional special license plates in that series. The department shall continue to issue special license plates of that series until the existing inventory is exhausted."

SECTION    2.    This act takes effect upon approval by the Governor.
