ESTIMATED FISCAL IMPACT ON GENERAL FUND EXPENDITURES:

EXPLANATION OF IMPACT:

Department of Labor, Licensing and Regulations

    The department has indicated this bill would have no impact on the department, the General Fund of the State, nor on federal and/or other funds because it would not affect program services.

Department of Health and Human Services

    Enactment of this bill would have no impact on the department. Medication administration in-service education is already required by licensing regulations.

Department of Mental Health

    The department contracts out for service in residential care facilities. Any costs or savings would accrue to the provider of service to the facilities and is not expected to impact the fees charged to the Department of Mental Health.

Department of Disabilities and Special Needs

    The department operates residential care facilities. There would be no cost in taking advantage of the provision of the bill allowing unlicensed medical personnel to administer medications. There would be potential increases in efficiency in redistributing workload of personnel. However, there would be no direct savings.

Department of Alcohol and Other Drug Abuse Services

    The department's local county provider system operates residential care facilities. There would be no cost in taking advantage of the provision of the bill allowing unlicensed medical personnel to administer medications. There would be potential increases in efficiency in redistributing workload of personnel. However, there would be no direct savings.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 40-33-980 SO AS TO AUTHORIZE LICENSED NURSES TO TRAIN AND SUPERVISE SELECTED UNLICENSED PERSONS TO PROVIDE ORAL AND TOPICAL MEDICATIONS, REGULARLY SCHEDULED INSULIN, AND PRESCRIBED ANAPHYLACTIC TREATMENTS IN COMMUNITY RESIDENTIAL CARE FACILITIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The 1976 Code is amended by adding:

    "Section 40-33-980.    In community residential care facilities, the provision of selected prescribed medications may be performed by selected unlicensed persons with documented medication training and skill competency evaluation. The provision of medications by selected unlicensed persons is limited to oral and topical medications and to regularly scheduled insulin and prescribed anaphylactic treatments under established medical protocol and does not include sliding scale insulin or other injectable medications. Licensed nurses may train and supervise selected unlicensed persons to provide medications and, after reviewing competency evaluations, may approve selected unlicensed persons for the provision of medications."

SECTION    2.    This act takes effect upon approval by the Governor.
