STATEMENT OF ESTIMATED FISCAL IMPACT

REVENUE IMPACT 1/

The Office of Economic Research has reviewed the bill and has determined that there is no impact on state or local general fund revenue in FY 2003-04.

Explanation

This bill makes a definitional change to "public facilities" by adding another sub-item. Specifically, this bill adds public parking garages or related facilities to the definition of "public facilities".

This action in effect allows local governments to spend development impact fees on public parking garages or related facilities. This bill relates to development impact fees which are a local government revenue. The Office of Economic Research has reviewed the bill and has determined that there is no impact on state or local general fund revenue in FY 2003-04.

1/ This statement meets the requirement of Section 2-7-71 for a state revenue impact, Section 2-7-76 for a local revenue impact, and Section 6-1-85(B) for an estimate of the shift in local property tax incidence.

A BILL

TO AMEND SECTION 6-1-920, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS USED IN THE "SOUTH CAROLINA DEVELOPMENT IMPACT FEE ACT", SO AS TO ADD TO THE DEFINITION OF "PUBLIC FACILITIES", PUBLIC PARKING GARAGES OR RELATED FACILITIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 6-1-920(18) of the 1976 Code, as added by Act 118 of 1999, is amended by adding:

"(i)    public parking garages or related facilities."

SECTION    2.    This act takes effect upon approval by the Governor.
