A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-1-93 SO AS TO PROVIDE THAT THE OWNER OF A PRIVATE POND WHO HAS POSTED HIS PROPERTY WITH CLEARLY VISIBLE SIGNS PROHIBITING TRESPASSING UPON THE PREMISES MAY NOT BE HELD LIABLE FOR ANY INJURY SUSTAINED BY A PERSON WHO WAS TRESPASSING ON THE PROPERTY AT THE TIME OF THE INJURY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 50 of the 1976 Code is amended by adding:

"Section 50-1-93.    An owner of a private pond who has posted his property with clearly visible signs prohibiting trespassing upon the premises may not be held liable for any injury sustained by a person who was trespassing on the property at the time of the injury."

SECTION    2.    This act takes effect upon approval by the Governor.
