TO AMEND ARTICLE 3, CHAPTER 11, TITLE 50, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-11-318 SO AS TO PROVIDE THAT HUNTERS IN GAME ZONES 1, 2, AND 4 AND ON ALL WILDLIFE MANAGEMENT AREA LANDS MUST WEAR A HAT, SHIRT, COAT, OR VEST OF SOLID VISIBLE INTERNATIONAL ORANGE DURING ANY GUN SEASON, TO PROVIDE THAT "GUN SEASON" MEANS ANY OPEN SEASON OR OTHER PERIOD WHEN A HUNTER IS AUTHORIZED TO USE OR USES ANY CENTER-FIRE OR RIM-FIRE RIFLE, SHOTGUN, PISTOL, OR MUZZLE-LOADING FIREARM, TO PROVIDE EXCEPTIONS, AND TO PROVIDE PENALTIES FOR VIOLATIONS OF THIS SECTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 3, Chapter 11, Title 50 of the 1976 Code is amended by adding:
"Section 50-11-318. Except as provided in this section, all hunters in Game Zones 1, 2, and 4, and on all Wildlife Management Area lands must wear a hat, shirt, coat, or vest of solid visible international orange while hunting during any gun season.
As used in this section, 'gun season' means any open season or other period when a hunter is authorized to use or uses any center-fire or rim-fire rifle, shotgun, pistol, or muzzle-loading firearm.
This section does not apply when hunting for migratory birds, turkey, lawfully hunting at night, or occupying an elevated stand more than six feet above ground level.
A person who violates this section is guilty of a misdemeanor and, upon conviction, must be fined not less than twenty-five dollars or more than two hundred dollars, or imprisoned for not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
